These Terms are an agreement between you and Brand X Agency LLC and Travis Brady ("Brand X," "we," "us") for your use of Brand AI Cortex at app.brandaicortex.com (the "Cortex"). By creating an account or using the Cortex, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Cortex.
You must be at least 18 years old and able to enter a binding contract. If you use the Cortex for a business, you confirm you have authority to bind that business.
Keep your password private. You're responsible for activity under your account. Tell us right away if you think someone else has accessed it.
The Cortex helps you discover your leadership archetype, organize your story and brand, and use artificial intelligence ("AI") to draft content, brand boards, logos, avatars and marketing material. Features, limits and plans may change as we improve the product. Features marked "Next Level" or "beta" may be incomplete.
You own what you put into the Cortex (your story, answers, files, photos and brand details) and what it creates for you ("Your Content"). You give us a limited license to store, process and send Your Content to our service providers only as needed to run the Cortex for you. We do not sell Your Content and we do not use it to advertise to others.
You confirm you have the rights to everything you upload, including photos of any person in them. Only upload photos of yourself or of people who have given you permission.
AI output can be wrong, incomplete or similar to content created for others. Review everything before you publish or rely on it. You are responsible for how you use output, including checking that names, logos and claims don't infringe anyone's rights and that marketing claims are truthful. We don't guarantee that any name, logo or design can be trademarked.
Don't use the Cortex to break the law; harass, impersonate or defame anyone; create sexual content involving minors or non-consensual imagery; upload malware; scrape, reverse engineer or overload the service; share your account; or try to get around daily limits. We may suspend or close accounts that break these rules.
The Cortex software, the Brand X name and logos, the archetype framework, workbook, training content and design are owned by Brand X Agency LLC and Travis Brady. You may not copy or resell them. Your use of the Cortex doesn't give you ownership of them.
If you opt in, we'll send texts as described in our SMS Terms. We may email you about your account, and, with an unsubscribe link, about tips and offers.
You can cancel a paid plan anytime; it stays active to the end of the period you paid for. You can ask us to delete your account and data by contacting us.
The Cortex is provided "as is" and "as available." We don't promise it will be uninterrupted or error-free, or that it will produce any particular business result, income or audience growth. Results depend on you.
To the fullest extent the law allows, Brand X Agency LLC and Travis Brady are not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, data or goodwill. Our total liability for any claim relating to the Cortex is limited to the amount you paid us in the 3 months before the claim, or $100 if you've paid nothing.
You agree to cover our reasonable losses and legal costs if a third party makes a claim because of Your Content or your breach of these Terms.
These Terms are governed by the laws of the State of Arizona. Any dispute will be handled in the state or federal courts located in Maricopa County, Arizona, and you agree to those courts' jurisdiction.
We may update these Terms. If a change is significant, we'll tell you in the app or by email. Using the Cortex after the change means you accept it.
